Please read these Terms of Service carefully before using MindPath (Disorder DiagnAvIgator).
1. Acceptance of Terms
By clicking "Sign Up," "I Agree," or by accessing the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business (e.g., a clinic or studio), you represent that you have the authority to bind that entity.
2. The Service & No Medical Advice (Critical for DiagNav)
DiagNav.site is a clinical support and research tool. It is designed to assist professionals, not replace professional clinical judgment.
Disclaimer: Use of these tools does not constitute a doctor-patient relationship. We do not provide medical, psychological, or diagnostic advice. All clinical decisions remain the sole responsibility of the user.
3. User Obligations & Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate information and to use the Service in compliance with all applicable Australian laws, including the Privacy Act 1988 (Cth).
4. Intellectual Property
All content, code, logos, and "look and feel" of the sites are the exclusive property of Bruce R. Long (or your relevant business entity). We grant you a limited, non-exclusive, revocable license to use the apps for their intended purpose while your subscription is active.
5. Limitation of Liability
To the maximum extent permitted by law:
- Cap on Liability: Our total liability for any claim arising out of or relating to the Service shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
- Exclusion of Consequential Damages: In no event shall we be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or clinical errors made by the user, even if we have been advised of the possibility of such damages.
6. Subscriptions & Billing
Subscriptions are billed in advance. Unless otherwise stated, payments are non-refundable. We reserve the right to change pricing with 30 days' notice.
7. Termination
We may suspend or terminate your access immediately if you breach these terms or if your use of the site poses a security risk or legal liability.
8. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of NSW.
